Collaborative Divorce: Neutal Facilitator + Mediation
Collaborative Divorce is a peaceful process to resolve divorce. The Collaborative Divorce Process engages a professional team consisting of a lawyer for each spouse, plus a neutral facilitator to help you in making the best decisions about your future, as well as retain control over your divorce and other family matters. This process helps you keep your dispute private, and plan a better future for your re-structured family without battling each other in court.
A Collaborative Neutral Facilitator is a neutral professional in a collaborative divorce. He or she is oftentimes utilized as a team leader and communication specialist within the collaborative family law process. He or she generally has a background in family dynamics, childhood development, and/or conflict management.
Mediation is a private, confidential, and voluntary process whereby a neutral third party assists people in conflict in settling the issues between them without having to go through the lengthy and often costly court process. Parties are usually ordered by the Court to attempt to mediate their differences before scheduling a hearing. By fully engaging in the process, parties retain control and are often able to identify creative and flexible solutions, which would not be available to them through the courts. The mediated settlement agreement is then incorporated into a court order. (Chapter 61.183, Florida Statutes)
